Do I Have to Give Consent to a Law Enforcement Officer to Search My Car in Florida?
The simple answer is no, you do not. The 4th amendment requires the police to have a warrant in order for them to search your car. One way for the police to get around that warrant requirement is for you to give consent. The reason you should not give consent is constitutionally you are protected from the police searching your car without a warrant, therefore I always advise my clients to never give consent to search their vehicle.
